This ordinance gives tenants, tenants associations, the city, and nonprofit groups the right of first refusal when an owner proposes to sell, transfer or otherwise terminate affordable housing units that have been subsized by HUD. The ordinance creates a 'fair return price' formula for HUD-subsidized affordable housing that current ownership intends to terminate, creates notice requirements for affordable housing termination, and established relocation fees paid by property owners to those displaced by affordable housing conversion or termination. This ordinance assists public and private efforts to preserve and promote affordable housing and to protect community diversity by preventing displacements of low and moderate income households.
